Definitions

In these Terms, the following definitions apply:

  • Amen.Travel — the content partnership service operated by Afrofeast (ABN available on request), based in Australia.
  • Client — the hotel, resort, property, or individual who has engaged Amen.Travel under a confirmed package booking.
  • GM / Owner — the General Manager or property Owner designated as the Client's authorised representative and primary point of contact throughout the partnership.
  • Content — all photography, video, written captions, hashtags, Google Maps listings, and associated media created under the partnership.
  • Agreement — the Partnership Agreement signed by both parties, together with these Terms and the selected Package details.
  • Package — the selected service tier (Essentials, Social Suite, Full Social, or Full Campaign) as detailed on amen.travel/partner.

Scope of Services

Amen.Travel will provide the services described in the selected Package, which may include editorial photography, social media content creation (Instagram, TikTok, Pinterest), Google Maps optimisation, and audience distribution across Afrofeast's platforms.

Any services not explicitly listed in the confirmed Package are out of scope. Additional services may be agreed in writing at an additional fee.

Amen.Travel reserves the right to decline or cancel a booking where the property does not meet reasonable creative or safety standards, with full deposit refunded.

Booking & Payment

Deposit: 50% of the total package fee is due within 7 days of booking confirmation to secure the dates. No dates are held without a paid deposit.

Balance: The remaining 50% is due no later than 30 days before the agreed stay commences.

Installments: Where an installment plan is selected on the partner page, the schedule agreed at checkout applies. Late installments may result in a hold on content delivery.

Accommodation Exchange: Where the Client opts for the accommodation + meals exchange (in lieu of full cash payment), no cash refund applies. A free reschedule within 12 months is available.

Currency: All fees are quoted and charged in USD unless otherwise agreed in writing.

Payment processing: Payments are processed securely via Stripe. Amen.Travel does not store card details.

Cancellation Policy

Cancelled more than 60 days before the stay: Full deposit refunded. No penalty.

Cancelled 30–60 days before the stay: 50% of the deposit is forfeited. The balance is not charged.

Cancelled less than 30 days before the stay: Full deposit is forfeited, plus 25% of the remaining balance is invoiced to cover committed production costs.

Accommodation-only bookings: No cash refund. Free reschedule within 12 months.

Cancellation by Amen.Travel: In the event Amen.Travel must cancel due to circumstances beyond its control (illness, travel restrictions, force majeure), a full refund of all amounts paid is issued, or a reschedule is offered at the Client's choice.

Content Approval & Materials

All materials used in the production of Content — including shot lists, mood boards, wardrobe, props, and locations within the property — must be approved by the Client's GM or Owner before any shoot commences.

Amen.Travel operates a four-stage approval process:

  1. Pre-shoot approval — shot list, mood board, locations, and wardrobe direction submitted to the GM/Owner for written sign-off.
  2. On-site check-in — daily briefing with the designated GM/Owner contact to confirm the day's shoot plan.
  3. Post-production review — edited content submitted to the GM/Owner for review before any scheduling or posting.
  4. Final written sign-off — no Content is published to any platform without explicit written approval from the Client.

Revisions: Two revision rounds are included per package — one major (structural changes) and one minor (copy, colour, cropping). Revisions beyond this scope are billed at USD 75/hour.

Approval window: The Client agrees to respond to each approval request within 48 hours. Delays beyond 48 hours may affect delivery timelines.

Intellectual Property

Content licence to Client: Upon full payment, the Client receives a perpetual, royalty-free licence to use all delivered Content across their own marketing channels (website, social media, print, OTA listings).

Amen.Travel rights: Amen.Travel and Afrofeast retain the right to publish Content across their own platforms (Instagram, TikTok, YouTube, Pinterest, Google Maps, and others) as part of the agreed partnership. This is a core element of the service and cannot be excluded.

Ownership: Copyright in all Content remains with Amen.Travel / Afrofeast. The Client receives a licence, not ownership, unless a full copyright assignment is separately agreed in writing at an additional fee.

Credit: Where reasonably possible, the Client will credit @afrofeast when reposting Content on their own social channels.

Code of Conduct

Both parties agree to the following standards throughout the partnership:

  • Content will accurately represent the property. No misleading claims about facilities, pricing, or availability will be made.
  • Guest privacy will be respected at all times. Guests will not be photographed or filmed without explicit consent.
  • Unpublished rates, internal operations, and confidential business information shared by the Client will not be disclosed by Amen.Travel.
  • Amen.Travel will not feature competing properties in the same content cycle without prior written consent from the Client.
  • The Client will provide a safe, respectful working environment for Amen and any accompanying team members.
  • Content removal requests from the Client will be honoured within 48 hours for reasonable cause (e.g. health and safety concern, factual error, guest consent issue).

Dispute Resolution

Step 1 — Direct resolution: Either party must raise a concern in writing (email) within 7 days of the issue arising. Both parties agree to respond within 48 hours and attempt to resolve the matter directly.

Step 2 — Mediation: If the matter is unresolved after 14 days, both parties agree to engage a neutral third-party mediator before pursuing any legal action. Mediation costs are shared equally.

Step 3 — Legal proceedings: If mediation fails, either party may pursue legal remedies under Australian law.

Specific scenarios:

  • Hotel refuses accommodation after booking confirmed: Full deposit refunded to Amen.Travel, plus a cancellation fee equal to 25% of the package value.
  • Content published without Client approval: Content taken down within 24 hours. No further penalty if the error was unintentional and corrected promptly.
  • Creative dissatisfaction after approvals given: Not grounds for refund where the brief was followed and all approval stages were completed by the Client.
  • Payment dispute: Content delivery pauses until resolved. Content already delivered and approved remains the Client's to use.

Governing law: These Terms are governed by the laws of Australia. Both parties submit to the non-exclusive jurisdiction of Australian courts.

Limitation of Liability

Amen.Travel's total liability to the Client under any claim arising from a partnership shall not exceed the total fees paid by the Client for the relevant Package.

Amen.Travel is not liable for indirect, consequential, or speculative losses including lost revenue, lost bookings, or reputational damage claimed to result from Content.

Amen.Travel is not responsible for platform algorithm changes affecting content reach after publication.

Amendments

These Terms may be updated periodically. The version in effect at the time of booking applies to that engagement. Clients will be notified of material changes by email.
